ScareTicket

Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, checkout flows, digital tickets, order management tools, and related services (collectively, the “Services”) operated by ScareTicket, LLC, a Connecticut limited liability company (“ScareTicket,” “we,” “us,” or “our”), including https://scareticket.com and any subdomains or applications we operate for ticketing.

By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Our Role: Ticketing Facilitator

ScareTicket provides technology that helps you discover events, purchase admission, receive digital tickets, and manage orders. ScareTicket does not produce, promote, operate, or control any event. Each event listed through the Services is offered by an independent third party (“Organizer”).

When you purchase a ticket, you are entering into an agreement with the Organizer for admission to or participation in that event. ScareTicket facilitates that transaction by providing the Services and, where applicable, payment processing technology. Unless we clearly state otherwise for a specific transaction, ScareTicket is not the merchant of record for the underlying event admission and is not responsible for the event itself.

Event descriptions, dates, times, locations, pricing, age restrictions, health and safety information, and refund or transfer policies are set by the Organizer. ScareTicket may display Organizer-supplied information but does not guarantee its accuracy or completeness.

Eligibility

You must be able to form a binding contract under applicable law to use the Services. If you purchase tickets on behalf of others, you represent that you have authority to do so and that the information you provide is accurate. Some events impose age or other entry requirements; you are responsible for meeting those requirements. If you are under 18, you should use the Services only with permission from a parent or legal guardian.

Accounts, Orders, and Communications

You are responsible for maintaining the confidentiality of any access credentials associated with your orders and for all activity conducted through those credentials. You agree to provide accurate contact information so we and the Organizer can deliver tickets, receipts, and event-related notices.

You consent to receive transactional communications related to your purchases (for example, confirmations and ticket delivery) by electronic means. Marketing messages, if any, will be sent only where permitted by law and in accordance with our Privacy Policy.

Payments, Fees, and Taxes

Prices, fees, and taxes displayed at checkout are determined by the Organizer and applicable law. Payment processing may be provided by third parties such as Stripe. You authorize us and our payment partners to charge your selected payment method for the total amount shown at checkout.

Failed or reversed payments may result in cancelled orders or invalidated tickets. You are responsible for chargebacks only to the extent they arise from unauthorized use of your payment method or disputes you initiate without a good-faith basis; fraudulent chargeback activity may result in suspension from the Services.

Tickets, Admission, and Event Policies

Digital and other tickets are valid only as described at purchase and subject to the Organizer’s rules. The Organizer decides whether to honor refunds, exchanges, transfers, rain dates, cancellations, or capacity changes. For event-specific questions—including refunds, transfers, postponements, and cancellations—contact the Organizer first. ScareTicket may assist with technical issues (for example, accessing an order) but defers to Organizer policies for event decisions.

Admission is at the Organizer’s discretion. You may be refused entry for failure to comply with event rules, safety requirements, intoxication, disruptive behavior, or other lawful reasons, without refund unless the Organizer provides otherwise.

Haunted attractions and similar live events may involve intense audio, lighting, enclosed spaces, uneven surfaces, and other conditions. You assume risks inherent in attending such events. If you have medical conditions or sensitivities, consult the Organizer before attending.

Ticket Sharing

The Services may allow you to generate links to share individual tickets with others. Shared links can grant access to a ticket without exposing your full order. Once created, a share link may not be deleted or changed. Anyone with the link may be able to use the ticket.

Share links only with people you know and trust. Do not use share links to sell tickets to strangers or to buy tickets from unknown sellers. Unauthorized resale or scalping may violate Organizer policies and applicable law.

Discount and Promotional Codes

Discount or promotional codes are created and controlled by Organizers unless we state otherwise. Codes may have expiration dates, usage limits, and eligibility rules. Unless prohibited by the Organizer, code settings may be changed after first use, and subsequent uses will follow the updated settings. Misuse of codes (including fraud or circumvention of limits) may result in cancelled orders or suspension.

Acceptable Use

You agree not to:

  1. use the Services in violation of any law or Organizer policy;
  2. attempt to gain unauthorized access to the Services, other users’ accounts, or our systems;
  3. interfere with or disrupt the Services or related networks;
  4. scrape, harvest, or collect user or event data without authorization;
  5. resell or broker tickets except where expressly permitted by the Organizer;
  6. use bots or automated means to purchase tickets in violation of Organizer rules or applicable law;
  7. submit false, misleading, or fraudulent order or payment information;
  8. reverse engineer, decompile, or copy the Services except as permitted by law; or
  9. infringe the intellectual property, privacy, or other rights of ScareTicket, Organizers, or third parties.

Intellectual Property

The Services, including software, branding, and site content owned by ScareTicket, are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, lawful ticket purchases and order management. Event names, logos, and related materials belong to their respective owners.

If you submit content to us (for example, through a support request), you grant ScareTicket a non-exclusive license to use that content solely to operate, support, and improve the Services and to resolve your request.

Third-Party Services and Links

The Services may link to or integrate with third-party sites and tools (including payment, email, analytics, and status providers). We do not control third parties and are not responsible for their content or practices. Your use of third-party services is subject to their terms and policies.

Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. ScareTicket disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, that defects will be corrected, or that the Services will meet your requirements.

Without limiting the foregoing, ScareTicket makes no warranties regarding any event, venue, Organizer action or omission, weather, scheduling changes, or the quality or safety of any experience.

Limitation of Liability

To the fullest extent permitted by law, ScareTicket and its members, managers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Services or any event, whether based on contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, ScareTicket’s total liability for any claim arising out of or relating to the Services or these Terms is limited to the greater of (a) the fees paid by you to ScareTicket for the specific order giving rise to the claim during the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law (including fraud or willful misconduct where non-waivable).

Indemnification

You agree to indemnify and hold harmless ScareTicket from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, your violation of Organizer policies or applicable law, or your dispute with an Organizer or other attendee, except to the extent caused by ScareTicket’s gross negligence or willful misconduct.

Suspension and Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, pose a fraud or security risk, or if required by law. Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law).

Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Material changes will take effect no sooner than the date posted unless otherwise required by law. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

Disputes and Governing Law

These Terms are governed by the laws of the State of Connecticut and the United States, without regard to conflict-of-law principles. You agree that exclusive jurisdiction for disputes relating to these Terms or the Services lies in the state or federal courts located in Connecticut, and you waive any objection to venue in those courts.

Before filing a claim, you agree to contact us at help@scareticket.com and attempt in good faith to resolve the dispute informally.

General

These Terms, together with the Privacy Policy and any order-specific terms presented at checkout, constitute the entire agreement between you and ScareTicket regarding the Services. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
